View disputes can quickly escalate from a minor nuisance into a significant legal battle. It can start as a neighbor-to-neighbor dispute over trees, shrubs, and structures such as outdoor fireplaces or home improvements. These issues can be prevented by a well-written set of governing documents that provide view and privacy protections for members. These protections need to be compliant with municipal and governmental regulations and enforced by the Association. Consideration also needs to be given to property upgrades and the aesthetic harmony of the community, set-back requirements, open space easements, etc. If a dispute arises, we work to provide legal solutions that can mitigate the Association's liability and, if necessary, our litigation attorneys are adept in representation through disputes.
